EXEMPTION FROM SUBSECTION 704.111 (1) OF THE CANADIAN AVIATION REGULATIONS AND SUBPARAGRAPH 724.26(2)(c)(vii) OF THE COMMERCIAL AIR SERVICE STANDARD

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators and flight crew members from subsection 704.111(1) of the Canadian Aviation Regulations (CARs), and subparagraph 724.26(2)(c)(vii) of the Commercial Air Service Standard (CASS), made pursuant to subsection 704.26(3) of the CARs subject to the following conditions.

Subsection 704.111(1) of the CARs stipulates that the validity period of a Pilot Proficiency Check (PPC) and of the annual training referred to in section 704.115 of the CARs expires on the first day of the thirteenth month following the month in which the proficiency check or training was completed. 

Subparagraph 724.26(2)(c)(vii) of the CASS made pursuant to subsection 704.26(3) of the CARs stipulates that the Pilot-in-Command, and the Second-in-Command, if authorized by the air operator for lower than normal take-off minima, shall be checked within the preceding 12 months in an approved synthetic flight training device by an approved company check pilot or a Transport Canada Inspector and shall be certified in their pilot training files as competent to conduct an RVR 600 feet take-off.

PURPOSE

The purpose of this exemption is to:

Change the validity period of a PPC to the first day of the twenty fifth month following the month in which the proficiency check was completed;

Allow air operators using the PPC structure provided for under this exemption, that are also authorized in their Air Operator Certificate to conduct RVR 600 take-offs, to have the Chief Pilot, or his or her delegate, certify the pilot-in-command and second-in-command if authorized by the air operator for lower than normal take-off minima, as competent to conduct an RVR 600 take-off at the midpoint of the PPC validity.  This certification is in lieu of the annual check within the preceding 12 months in an approved synthetic flight training device by an approved company check pilot or a Transport Canada Inspector. 

APPLICATION

This exemption applies to Canadian air operators and flight crew members holding a valid PPC completed on or after July 1, 1999 for aircraft operated pursuant to subpart 704 of the CARs.

This exemption also applies where an air operator has been authorized aeroplane groupings for PPCs (renewal only) for aeroplanes operated pursuant to subpart 704 of the CARs.

CONDITIONS

This exemption is subject to the following conditions:

  1. Extensions in accordance with subsection 704.111(3) of the CARs to the validity period of a PPC, a Competency Check and the annual training shall not be permitted;
  2. Where an air operator has been authorized aeroplane grouping for PPCs (renewal only), the validity period of the PPC grouping shall be to the first day of the twenty fifth month following the month in which the proficiency check was completed subject to condition 3;
  3. Annual training is still required in accordance with sections 704.115, 724.115 of the CARs and for aeroplanes, paragraph 724.108(2)(b) of the CASS;
  4. The air operator shall provide and the flight crew members shall complete additional training as described in Appendix “A” within ninety days prior to the first day of the thirteenth month of the validity period;
  5. The air operator shall provide flight crew members with documentary proof of pilot qualifications in a format that is easily available for review while engaged in flight operations.  This record should be in the form of a card listing, at the minimum, the type of aircraft, the name and license number of the training pilot as per condition 6 below, and the date until which the PPC is valid.  Additional training information may be included on the card if desired.  A sample “Flight Crew Member Record of Training” card is attached as Appendix “B”;
  6. The pilot’s Flight Crew Member Record of Training card shall be signed by the Chief Pilot or a training pilot delegated by the Chief Pilot to verify that “annual training has been completed in lieu of a PPC.”  The documentary proof of pilot qualifications shall be carried at all times while exercising the privileges granted by this exemption;
  7. Air Operators that are authorized to conduct RVR 600 take offs in their Air Operator Certificate, that are using the PPC structure provided for under this exemption, shall have the chief pilot, or his or her delegate, certify that the pilot-in command and second-in -command if authorized by the air operator for lower than normal take-off minima are competent to conduct RVR 600 takeoffs at the mid-point of the PPC validity upon completion and satisfactory demonstration of the annual training requirements; and
  8. The pilot-in-command and second-in-command if authorized by the air operator for lower than normal take-off minima, shall be certified in their pilot training files as competent once the certification referred to in condition 7 is obtained. 

VALIDITY

This exemption is in effect until the earliest of the following:

  1. 23:59 EST on 30 June, 2007;
  2. The date on which any of the conditions set out in this exemption is breached;
  3. The date on which the exemption is superseded by an amendment to subsection 704.111(1) of the CARs;
  4. The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.

APPENDIX “A”

Additional training shall be completed in lieu of the annual PPC in accordance with the following:

  1. The air operator shall submit for the approval of the Regional Manager Commercial and Business Aviation, a training program, which provides for additional training in lieu of the PPC.  For turbo-jet aircraft, this additional training shall be conducted in a synthetic training device if a synthetic training device for the type is available in North America, or on the aircraft if a synthetic training device is not available in North America.  For turbo-prop aeroplanes or turbine powered helicopters, Transport Canada encourages operators to conduct training on the simulator.
  2. The training referred to in this appendix shall be in addition to the normally required training and be of at least 1.0 to 1.5 hours duration for each crew member.  A minimum of one leg of the training flight shall be flown by each crew member. 
  3. The additional training, when conducted in a synthetic training device shall consist of one of the following:
    1. A Line Oriented Flight Training (LOFT) scenario where the synthetic training device capability permits and meets the requirements of a LOFT, and the operator has developed a LOFT program;
    2. A training session patterned on a PPC profile in section 724.108 (Aeroplane) schedule I, or the schedule in section 724.108 (Helicopter) of the CARs; emphasis shall be placed on:
      • Non Precision Approaches
      • Holds
      • Precision Approaches
      • Missed Approaches with Power Loss; or,
    3. An alternate training profile submitted by the operator and approved by Transport Canada.
  4. If the additional training is completed in the synthetic training device, the 24 month PPC shall also be completed in the synthetic training device.
  5. Where a synthetic training device for turbo-jet aircraft is not available in North America, or its capability does not permit, or in the case of turbo-prop aeroplanes or turbine powered helicopters, where the operator has chosen not to utilize a synthetic training device, the additional training flight, on an aircraft, in lieu of the PPC shall consist of one of the following:
    1. A training session patterned on the PPC profile in section 724.108 (Aeroplane) Schedule II, or the schedule in section 724.108 (Helicopter) of the CARs; emphasis shall be placed on:
      • Non Precision Approaches
      • Holds
      • Precision Approaches
      • Missed Approaches with Power Loss; or
    2. An alternate training profile submitted by the operator and approved by Transport Canada.
  6. The Chief Pilot shall be responsible for the training required by this exemption.  Where a pilot has not demonstrated proficiency on one or more items in the training program, supplementary training shall be provided.  The supplementary training shall be sufficient to ensure the pilot has demonstrated proficiency in all required items.  The Chief Pilot, or a training pilot delegated by the Chief Pilot, shall certify the proficiency of each pilot for all items contained in the appropriate Schedule of section 724.108 upon completion of the training.
